Breaking: Criminal referral filed against Nellie Ohr concerning congressional testimony after emails surface showing election-year contacts with DOJ
Now, a series of “Hi Honey” emails from Nellie Ohr to her high-ranking federal prosecutor husband and his colleagues raise the prospect that Hillary Clinton-funded opposition research was being funneled into the Justice Department during the 2016 election through a back-door marital channel. It's a tale that raises questions of both conflict of interest and possible false testimony.
It raises additional questions about potential conflicts of interest when it is being injected by a spouse working as a Democratic contractor trying to defeat Trump, and she is forwarding her own research to her husband's department and co-workers.

What Is A Criminal Referral?
Summary
For those not familiar with the term "criminal referral", in summary it means a recommendation to investigate is send to the Department of Justice (DOJ).A criminal referral is NOT to confuse with a request to start a criminal investigation right now. Details below.
Details
After the DOJ receive the criminal referral, the DOJ will:
- Review it. Based on laws. Not based on politics.
- DOJ will decide if either a criminal investigation or a prosecution is needed or not. Again based on laws. Not based on politics.
- If the DOJ decide that either a criminal investigation or a prosecution is needed, they may or may not publish it on their website at https://www.justice.gov/news
The full process is much more complex than this. The above is the boiled down version of the main steps. More details below.
A criminal referral or criminal recommendation is a notice to a prosecutory body, recommending criminal investigation or prosecution of one or more entities for crimes which fall into that body's jurisdiction.
In the U.S. federal government, regulatory and law enforcement agencies that investigate crimes must typically refer cases to the Department of Justice for prosecution at its discretion. These referrals may not require formal documentation, but may include a case report. In a direct referral, agencies refer cases to the U.S. Attorney in the district where the crime occurred. The United States Congress and its members, in their investigative role, issue criminal referrals to the Justice Department as well.
State attorneys general often refer federal crimes to the Justice Department. Investigative bodies under the Justice Department itself may also issue referrals to U.S. Attorneys, such as the case against Michael Cohen in the Southern District of New York, which was referred by the Mueller investigation.
Private counsel may also make criminal referrals on behalf of clients who have been victims of both civil and criminal wrongdoing.
Some state attorneys general must receive a criminal referral from the state executive before pursuing criminal charges.
