Twitter are a platform, not a publisher. If they control what they allow on their platform, then they are a publisher. There are different laws for platforms and publishers ... "publishers" can be sued for what appears on their service, platforms are protected under fair use. Twitter is trying to be both ... they are publishers while trying to hide behind the protection of platforms.

An argument can be made that it is a public utility and equal access should be provided for all. As widespread as the social media platforms have become and the fact that they are major forms of communication look for them to be regulated the same way television, telephone, newspaper, radio etc have been. These aren’t just “some company”- they’ve transcended that in terms of importance in today’s society.

In 1776 the Public Forum was 100% owned by the government. Becuase of this the 1st Amendment was created to avoid the dangers of such a monopoly.
In 2019, the Public Forum is owned by Internet Companies. (60% owned by Faceboom). We need 1st Amendment protections against the FB monopoly.

But they can’t. They must run advertisements for any political candidate that wants to use their airwaves. They must provide equal access at equal prices. They are not permitted to discriminate based on political affiliation. Same with radio. Same with newspapers. Social media has become just as widespread and the same rules are coming for them, guaranteed.

There is an implied contract between twitter and the user. Twitter is providing a service, and the user pays for that service by giving up privacy. Twitter profits off of this arrangement. I think it can be argued that Twitter shouldn't be selectively discriminating against a group of people based on political affiliation or anything else. I would like to see this argued in court. I think Twitter would lose.
