Classified info is the legal issue she faced. The law allowed use of personal email and the State Dept manual discussed what you needed to do if you used personal email. She stretched this to the limit of course, but this was not a criminal issue. The law has changed since then.
The State Dept still needed to comply with FARA.
As for going to jail NO ONE has ever faced arrest in similar cases in the history of the US. Anyone who has faced prosecution for mishandling classify info went beyond what she did.
