Yes, because a loophole is "an ambiguity or inadequacy in a system, such as a law or security, which can be used to circumvent or otherwise avoid the intent, implied or explicitly stated, of the system."

Loopholes concern laws. Why is this so confusing?

No, I'm not. I seriously want to know. You even said that we should fix preexisting laws, as in fixing loopholes. If fixing our gun control laws is preferable to legislating new ones (which I agree with), why is fixing loopholes so difficult to accomplish?
