Nobody goes to jail for a first offense. Certainly not for a brawl at a political protest. I don’t think he should be treated any differently than anyone else just because you don’t like his politics.

You are a damn moron to say you don't get jail time for a first offense. This wasn't a "brawl" this was a completely unprovoked attack.

Short of first degree murder pretty much everything is probation eligible.

Manslaughter gets probation all day long. Even if not a first offense. I’ve seen second degree murder get probation. Obviously it’s up to the judge but you’re acting like this out of the ordinary and you know nothing about criminal law.

Your characterization of an unprovoked attack is one side of the story. Defendant is entitled to present his side of the case.
