It is a bit different then stated here. OVH uses a modified version of ubuntu with also a modified kernel. In that case you need permission to use the ubuntu brand. Since the software you sell as ubuntu is actualy not as canonical released it. In that case you need a license with possible payment with canonical. So if they used a unmodified version of ubuntu they do not have to pay.
