Isn't that like telling a grociery store that they can't display Little Debbie products as Little Debbie because they don't own a the licence to the brand. They are offering their OS as as an option. Unless the trademark is being misapplied you produce your trademark to go with your product even where your product is out of your hands. It's supposed to reach the real world and not just your website.

That's the idea of branding, as in a cow sent out to pasture outside of your control.

No because the grocery store is not opening up the Little Debbie products, altering the contents, and then continuing to sell them as Little Debbie products. These guys are modifying Ubuntu, and the kernel, and selling it as Ubuntu.
