If it's in the comments section... That is really bad.
Section 230 of the CDA grants immunity, for good reason..
"No provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider."
Edit: I didn't go beyond the paywall. Saw the paste below. If a write on site did it, they are technically an agent/representative. I believe the service would in fact be responsible. 230 protects from users of a site/service.
