No reason not to. If you lose, you pay nothing for it. If you win, they can't ever get rid of you or at least they have to pay a lot to do so. Instituting at least some form of loser pays as well as getting rid of contingency based lawyering (where you pay nothing if you lose but the lawyer takes a huge chunk if you win) would fix a lot of that.

If you lose you still have to pay lawyer fees. Lawyers need a retainer up front. My bets are that she doesn't even have the retainer.
