Oracle has been fighting for years to make Google responsible for stealing code...
Individual programmers don't have the resources to fight for their intellectual property.
Also, copywriting optimal code would stifle new production. But something along these lines would be better than what exists now (and truthfully programmers learn these optimal codes and cut and paste algorithms all the time)
