Employers are lucky that programmers do not receive "residuals" like musicians, actors and the like. Imagine coming up with novel code and making bank for years on it as corporations continue to benefit from the programming you once did...

Oracle has been fighting for years to make Google responsible for stealing code...
Individual programmers don't have the resources to fight for their intellectual property.
Also, copywriting optimal code would stifle new production. But something along these lines would be better than what exists now (and truthfully programmers learn these optimal codes and cut and paste algorithms all the time)
