Opinion The New York Times

I Am Part of the Resistance Inside the Trump Administration

I work for the president but like-minded colleagues and I have vowed to thwart parts of his agenda and his worst inclinations. Sept. 5, 2018 https://archive.is/IPL8Q#selection-76.0-76.1

This story is garbage. It rehashes all the lefty incompetence porn in a single story. This porn only exists in the minds of lefties, not a purported conservative. Putting it all in one story does not make it more believable. Even if true, a conservative would never go public. They would keep working behind the scenes accomplishing the good things admitted by the story. Finally, a conservative would never praise John McCain. He is the embodiment of a uni-party RINO. Nope, this story is only intended to attack the president and stop his agenda. It was written by Sharia Blue.

Lets see what the future holds... Always jam tomorrow - over the next hill. Tuesday 9/11 could be a big day.

I feel the dam is about to burst - but the military courts don't seem to kick in until Jan 19

And yet I still look to MSM to confirm what is happening...

What Supreme Court case allows for the use of MI v Congressional assembled and approved agencies?

https://en.wikipedia.org/wiki/Johnson_v._Eisentrager [this seems to deal exclusively with aliens - not citizens]

Hamdan v. Rumsfeld, 548 U.S. 557 (2006) https://en.wikipedia.org/wiki/Hamdan_v._Rumsfeld#Stevens'_opinion_for_the_Court

Having read some Hamdan, it doesn't appear to endorse military commissions for civilians on the grounds that commissions don't give the same trial protections as civilian courts - I think the EO re military tribunals rectifies this - but don't take my word for it - I have found the whole military tribunal thing confusing from the get go.

I'm not persuaded that these cases are the keys to the Military tribunals for citizen enemies domestic (traitors)]

But Kavanagh, prospective Supreme Court Judge seemed to think they were...

Hamdi v Rumsfeld

This seems closer - deals with an American citizen - but it gives citizens a right to challenge their detention as an enemy combatant in the domestic courts.

https://en.wikipedia.org/wiki/Hamdi_v._Rumsfeld

https://www.law.cornell.edu/supct/html/03-6696.ZS.html

concluded that although Congress authorized the detention of combatants in the narrow circumstances alleged in this case, due process demands that a citizen held in the United States as an enemy combatant be given a meaningful opportunity to contest the factual basis for that detention before a neutral decisionmaker.
