Guy did fuck up twice but the cops did make this an unnecessarily difficult situation.

This only silver lining for me is that the guy is white. That when I say "I don't think the cop should be found guilty of a crime," I can't be called racist.

The cop was wrong in ALMOST every conceivable way, but not criminally. He appears to be a straight up, power tripping, asshole. He gives lots of confusing directions while yelling in a tone that made it even harder to follow the already confusing directions. He has a terrible personality and does a shitty job and should be fired. Also, the police department that decided to hire him, fail to train him, fail to recognize that he couldn't do his job, and allow him into the field should all be fired for this colossal fuck up.

However... the cop said "If you put your hands behind your back near your waistband again I'm going to shoot you" guy puts his hand down again, behind his back, near his waistband - cop does exactly what he said and shot the guy. And I can sympathize with the cop... Of all of his confusing directions, the guy chose that one to not follow. And that's the ONLY one that when he didn't follow and got shot I have to take a step back, sigh deeply, and say, "as much as I hate this cop and as badly as the cop handled this situation, the guy reached behind his back towards his waistband... even if I might not have shot him if I was in that cop's shoes, I can definitely understand how someone in that situation might" If the guy uncrossed his legs and the cop shot him, I'd grab my pitch fork and lead the charge. But I can't get behind the cop being "criminally" liable in this specific situation, as much as I hate him (from what I watched) and would probably feel happy if I heard he got hit by a train.

Mehhh. In this circumstance the man was no threat. The cop was basically already telling him he was going to shoot him. His commands were ridiculous and basically forcing the guy to fuck up. This guy seems to have made it where he could legally shoot this guy with a series of ridiculous commands. No reason not to have your partner cuff him when he was on his stomach. If I was on this jury I would have fought for a conviction.

I do think the cop shouting showed poor training/discipline with his use of words. But that wasn't the guy that shot him.

How many officers could not control one man on his knees without killing him? That is why there are federal civil rights laws. This may not be over.
