I don't think it actually has to do with having a physical presence does it? But even if it does, these days Amazon pretty much has a physical presence in every state for shipping and distribution reasons. I know that they charge tax in my state, but they don't have any data centers here that I know about.

It has everything to do with physical presence. It's a concept called, nexus. It means that a company has enough of a physical presence in a state that the state can enforce its sales tax laws on it.
