Well, we prosecute people for other immoral things (stealing, murder), why is cheating not prosecuted? I see no difference, in either case you're hurting another person/infringing on their rights in some way.

They made a choice to gamble that the cheater would be faithful and lost. Murder and theft are not directly related to a choice the victim made.

And marriage is a signed contract. I don't understand why it doesn't hold up in court like any other contract.

You don't add more rules just because we currently have a lot of rules. The slippery slope is a real thing.
