Beyond all reasonable doubt is already the standard, has been for decades, and still leads to situations where it's been proven that we've still had innocent people on death row for years.
Best solution I've come up with is life in prison for those cases, but if you have multiple executable offenses, separately tried, that's what capital punishment is for.
I'm aware of this and it isnt a suitable reason to give the death penalty for the reasons youve stated. I specifically mentioned incontrovertible evidence because it is essentially 100% proof of the commission of the crime. reasonable doubt can easily be overcome with a slick lawyer.
