What usually is the evidence that proves a hate crime(vs ordinary crime)?

Hate speech.

I can't downvoat yet.

But thanks for downvoating me because you think I'm ignorant.

I understand the difference.

The "hate" that modifies "crime" is taking an action that is already illegal and increasing the punishment.

The "hate" that modifies "speech" is taking a legal act and splitting into two categories: legal and non-legal.

My view is, if you're committing a crime that has a high likelihood of being considered a hate crime (assault, battery, rape, murder, manslaughter), there is already hate within the equation. How is a regular murder not a hate crime? How is a rape not a hate crime?

You're then not being punished only for the act, but the motivation of the attack. This isn't a big deal; it's the main difference between murder and manslaughter. But what it does is restrict speech, or forces us to restrict our own speech for fear of retalition by the long barrel of the law.

So you have the legal right to say anything as long as it doesn't correlate to a violent crime you commit?

Can you incite violence? Call for the death of all americans with german ancestry? As long as you commit no physical crime?

I don't think you know the answer to a lot of these questions, but I don't either. So maybe stop being a Faggitor and have a conversation instead of downvoting something you don't agree with and Reeeing at people to educate themselves.

I have educated myself. I continue to educate myself. I continue to wallow in my own ignorance.
