How they treat intentions as a practical matter in the real world, has exactly to do with how much will there is prosecute, not as some hard test. That's just how it is, where anyone who has ever been to court with full sets of lawers on both sides could easily attest to.

Its just as easy to argue that she intended to make the server for that purpose and at that moment she broke the law in taking action to do so, which would be true even if she failed to make the server or make it operational. Until you go to court, which they avoided, its all just talk. And all we saw was the public side.

We have court because investigations are meaningless with out the full process to test it.

For the down-voaters:

If any person on voat worked for the state department and decided to make a home server that was to convey work related material you know you would get hosed. You would likely at the very least end up in court, even if all that had happened was that there was evidence of my intent to do it and any other action to start to make the server. Hard to argue against that.
