"Law360, New York (January 26, 2015, 1:37 PM ET) -- Grain workers and a salvage contractor have urged the U.S. Supreme Court to revisit a decision releasing ConAgra Foods Inc. from a $160 million jury verdict stemming from an Illinois grain mill’s explosion, saying the appeals court created a new defense doctrine that replaces existing Illinois law. When the appeals court determined last year that under the audit interference doctrine ConAgra cannot be held liable for its portion of the $180 million total verdict because it hired West Side Salvage Inc. to rectify the unsafe conditions — thereby foisting the damages onto West Side — it violated the established comity principles by which federal courts are to decide state law issues, West Side and two sub-contractors told the U.S. Supreme Court in a Jan. 20 petition for a writ of certiorari.
“The Seventh Circuit did not simply expand Illinois law,” the petition says. “[The court] created a brand new defense to Illinois premises liability/bodily injury claims brought against property owners by invitees injured by dangerous conditions on the owner’s property.”
The appeals court violated the jurisdictional relationship between federal and state courts when it applied a doctrine designed to apply to contributory negligence in suits seeking financial damages from negligent auditors or accountants, instead of relying on general principles of duty, negligence and proximate cause appropriate for bodily injury and premises liability suits, the petition says.
Sub-contractors John Jentz and Robert Schmidt joined West Side to challenge the appeals court’s September decision, which that court later refused to consider rehearing en banc.
It determined that ConAgra cannot be held liable for its portion of the verdict because it hired West Side Salvage to rectify the unsafe conditions. The appeals court panel reversed the judgment against ConAgra, reversed the award of punitive damages against West Side Salvage and upheld compensatory damages against West Side."
