I'm not a lawyer and have absolutely no real idea but I think the difference here is between being re-sentenced and re-tried. With double jeopardy if you are found not guilty of a crime they can't charge you and try you again for that exact crime. If you're found guilty they can vacate the punishment and give you a new punishment because it's not a new trial for the same crime just a re-sentencing for a crime you've already been found guilty of.
