According to some news reports, the plan was to spit on him. Which is simple assault.
The argument is that no checking into his story was done after he was detained. If they had done a cursory search on him and found him making threats to attack the candidate and be a martyr they may have seen cause to keep him in custody for longer and possibly charge him with the threats.

I see nothing wrong with them letting him go free. I'm sure he is learning that everyone online already has a lot of his personal info and the sun is going down. Perhaps by morning he'll be begging to go back to the station?
