The clause is unlikely to hold any legal bearing in a number of countries across Europe as well as the United States.
First of all, misleading title, the clause wasn't inserted until a month after the hack, so they are still potentially liable for that.
Secondly, a good lawyer is the one that reads their TOS and can still find a way to sue them to oblivion (and win)
