See, this is why I hate other lawyers. If you have something to say, make your argument and let it stand on its own merits instead of appealing to authority.
Secondly, the ACPA only applies to trademarks and a "bad faith intent to profit from the goodwill (of said trademark)." Jeb Bush has not trademarked his own name. Strike one. Donald Trump is obviously not using Jeb's name to profit, he's using it to mock Jeb, which is perfectly legitimate. Strike two. The First Amendment may override certain applications of the ACPA. Strike three, Jeb! is outta here!!!

It doesn't seem like Trump and/or associates are trying to profit off of it. At least monetarily. Does profit in this instance implicitly refer to money? Or could the argument be used that his campaign for Presidency is profiting even though there are no monetary demands or gains being realized at the expense of Jeb Bush? Thanks for pointing that out. It is interesting. I need to stock up on more popcorn!

It's my understanding that Jeb! was insistent on including the "!" in the domain, and since he was so busy trying to get his brother and mother to persuade the IANA to change their protocol to allow www.Jeb!.com or www.Jeb!com, my campaign was able to register JebBush.com for him.
It's going to take this nincompoop a couple of days to wrap his little mind around the reality of this, but once he does, he will understand that I have done him an unbelievable favor, because I knew plenty of other people would want to register this domain. Mainly Teddy "Tall-Tale" Cruz, that smarmy rat-fink would love nothing more than to post more lies on the internet, and he'd be even more thrilled to do it under the guise of Jeb's name.
Look, I'm going to make America great again, and I mean it's going to be absolutely unbelievably great- for every American- and that includes Jeb Bush, who, while certainly not fit to be Commander in Chief, he's still a part of this country. So I'm going to do the right thing to help us win again, even if that includes helping to prevent little Jeb-Jeb from being slandered by Ted Cruzin'-for-a-Bruisin' Cruz.
As you know, I'm a tremendous businessman, and this just an example of the type of leadership that has resulted in my companies becoming the greatest in the world. My managerial acumen is absolutely off the charts- which, by the way, it's this type of instinct and judgement that this country needs in order to be successful. The past decade has been a total disaster.
Let's put an end to this, these nincompoops have been ruining our country for years. We don't win. We never win anymore- and let me tell you- This ends with me. We are going to be winners again. We will win. WE. WILL. WIN. WIN. WIN. WIN. ...AGAIN AND AGAIN AND AGAIN.
