Unless you can prove that the person behind the device was the only one capable of using that device at the time of offense, then youd be right. At least that's how it was explained to me during a portion of law enforcement training. However, that was more for things that would provide evidence towards prosecuting someone. Like if someone sent cp, death threats, or "im selling the drugs now!" If you're constantly downloading bootleg stuff from the same device, you might not be so lucky.

oh the FCC, i guess its time to run up their legal costs, significantly. everybody should start suing the shit out of the companies they represent for false advertising. the death of a thousand wounds. if being represented by the FCC is a industry and profit killer than companies will not ally with them, and their influence will go through the floor.
remember, anything and everything is defamation and harassment and you can sue any media company for expressing any view.
