New for Australia. No one has quite the cultures of lawsuits that the US has, however. It may not have come up there before.

In the US, see the talcum powder case, for instance, you don't even need to prove that the product harmed you. you just have to prove that the seller discussed internally whether it might be harmful and didn't disclose.
