it probably makes sense to clarify what exactly the Biden/McConnell rule is. First, it is not a law, but rather a principle without the force of law.

general speaking the "rule" is based on a speech from Joe Biden in June 1992 speech in which Biden argued that Bush should wait until after the election to appoint a replacement if a Supreme Court seat became vacant during the summer or should appoint a moderate acceptable to the then-Democratic Senate. McConnell clarified that this "rule" only applies where the President and the Senate are controlled by different parties.

eta; Biden in 2016: "I would go forward with the confirmation process as chairman. Even a few months before a presidential election... just as the Constitution requires."

To me, the Biden/McConell rule is nothing but a Mobster's Agreement. Each one stay in it's territory - cheating and stealing from their own people.
