No, they wont be charged, because they didn't break the law. A citizens's arrest of a fleeing suspect isn't breaking the law. The two men in the pickup didn't charge anyone. The thief charged someone holding a shotgun, thereby causing it to discharge. Case closed.

They will both be charged and convicted of first degree murder.
