It was a problem in the past, the incumbent would investigate their political opponent and accuse them of things whether they were guilty or not in order to sway the election. It's like a girl saying a guy rape them when they didn't. In the public eye a lot of people just believe you're guilty. It's a law that is meant to protect the underdog not protect criminal organizations. Unfortunately it works both ways as we can see.

Logic is orthogonal to politics!
Specifically, members of Congress cannot be arrested if on their way to official duties. Regardless of how criminal their actions prior to being "on their way" were!
