I think the judge is stepping out of line on this one. I am not a fan of the methods commonly used by Federal law enforcement (including stall tactics), but judges do not have the discretion to break the law. The general law says that LEO can investigate and prosecute a "criminal" up until the statute of limitation on that crime runs out. A popular word bandied about since Trump got elected has been "obstruction," so the judge needs some caution.
Also I've noticed that many people seem to think that prosecuting the deep state individuals is a one-shot deal. It's not. You can prosecute for leaking to the press and then later prosecute for FARA violations. It is not a case of either/or. LEO does this all the time.

The Fox headline is somewhat misleading ( not surprising with Fox) The Judge to the DOJ that if they didnt file charges by Nov 15 that he would release all the docs of the case to the public thru the active civil suit requesting the same. A Judge has no authority to order a Criminal Investigation to shut down/

I caught that too and would have pointed that out but you did a fine job stating the obvious. There was no demand to close the investigation, just a warning, telling them holding the info back from the public (stonewalling) has a time limit now. Tick, tick, tick ...
Also, playing Devil's advocate here, a stall tactic that has always worked well was to keep an investigation that was going to lead to no where open for years until public attention wanes and they quietly sweep it under the rug, in the mean time no dirt from FOIA requests get to the public in the interest of "protecting the investigation" which was just stonewalling to begin with.
