You can't protect an on going crime with property rights. Water rights are a complex topic in the west.

It's fucked up, but they moved there. They should have investigated more. In a lot of places when you purchase the land you do not automatically own the mineral rights.

On the other hand, I don't know how a pond denies the state the water in the first place especially when being used for irrigation since it will return naturally to the watershed.

Exactly. It's all about government asserting its rights over and above citizen's. Schools take parental rights away because they can. Courts force parents to make their children change their gender because they can. They force you to vaccinate your children because the pharmaceutical companies can require it. They tax your property because they can. And when they run out of money due to over spending they tax the rain water running off your property because they can.
