That the Obama administration fucked up on its rule making by violating the APA doesn't really surprise me. They were moving too far, too fast and doing it all through rulemakings and executive actions. But that is a fairly fundamental mistake there. And that does surprise me. Generally rulemakings are done by career bureaucrats who revel in their expertise in the arcana of what they do. To have been that sloppy suggests the careerists had little input and this was entirely done by the political appointees and their handpicked toadies.
