Philosophical question -- can it be an assassination attempt if the target isn't even there? I mean, if the target isn't present, there's no danger to the target, right?

It's an attempt if there's intent and some action taken with it. Whether or not it would have been successful isn't important.

From a legal standpoint it is still attempted murder. It is both criminal intent as well as action that could have led to death.

Philosophize all you want, the law is quite clear on this one.
