I thought that the law was if they rear ended you it was always their fault because you are suppose to leave an appropriate amount of distance between you and the car in front of you. How in the hell did they argue this away?!

I work for a PI/Litigation firm in Texas and I'm very impressed your insurance company stood up for you (it's very rare). That being said, the at fault drivers pre-existing medical conditions were likely taken into account during their "injury" diagnosis, so basically it would (appear) your insurance paid for their ER visit, which likely amounted to "your fat, these medical issues were caused by fat, get the fuck outta my hospital"

That fucking sucks. I guess the insurance thought it would cost them less to pay out, but it's really just rewarding shitty behaviour... Here's hoping they spend it all on food and get their beetus foot one step further into the grave.
