If you get hit from behind it is almost like per se negligence on the driver behind. You can probably file a counter claim and get back the damage to your car and any injuries you sustained. Why a lawyer would take on this case for the plaintiff's, I have no idea. They are going to lose money on this one.

They're trying to play an angle. An "anonymous witness" phoned in that I was driving erratically about half a mile back. If by erratically they mean five over the speed limit and changing lanes (with my turn signal!) to get around the slower vehicles, then I guess I was. However, that doesn't have anything to do with them rear-ending me, which is what my insurance guy told me as well.

That "anonymous witness" will be considered hearsay and probably wont be admitted into evidence. You should be fine. Everything is going to come down the officers wreck report. If that says you were hit from behind and you were not high or drunk, you will be fine.

Had a similar thing happen. Was in a drive threw before a shift and some butter beast thought it would be funny to back up into me. When I yelled at them to stop and pull forward they did.... then reversed again into me at higher speed...... buddy and his spawn get out of the car and they had to be 300 a piece if not more. They start screaming at me about what a prick I am and what not. That is until I get out of the car. Not exactly a smart choice to try to ram law enforcement off the road and try to screw with them at 4am prior to breakfast. Needless to say they didnt go any where for quite some time.

My dad is a fed. One day he told me this hilarious story that he and his partner were on the freeway and his partner wouldn't let this car into the lane. Either he cut the car off, or didn't let it in the lane, I cant remember. But anyway, the person decides to lug a full water bottle at their car window. Little did they know, they attempted to vandalize an undercover federal police car. So they flipped the lights on and pulled them over. Lo and behold they were two massive planets that looked straight from tumblr. Dyed hair, terrible clothing, piercings, everything. The type where you couldn't tell if they were male or female. So my dad and his partner surrounded their car and screamed at them. They were 'terrified' and 'triggered' so they starting holding each other's hands. Upon further investigation, they were a lesbian couple. I wish I could of been there to see the look on their faces. That shit must of been priceless.

What state do you live in (assuming America)? That just sounds crazy, in Virginia you can't make a claim like that. As a matter of fact you should have gotten a few dollars to fix your car. I also enjoy doing my own work, and when my Jeep was hit I just had to prove that I actually fixed it after I got the check.

Cheers! I have had 3 wranglers in my lifetime, no other vehicles. Worst I ever made someone do was give me 120 bucks for a new tow hitch after they rear ended me... though that tub of lard camry was opened like a tin can (rear ended me at a stop sign, on top of a very steep hill... I thought it was funny how the ball of the hitch split the hood)

I didn't file a claim against them, because I have no intention of fixing it. Like I said, it's a little bit of chipped paint and some scratches. The car's over a decade old, and while it still looks good for its age, I really don't care how the paint looks.

I, in no way have any sympathy for fats, but I worked in a setting where lawsuits were common and it is pretty standard practice for the lawyers to simply name everyone involved in the suit. Meaning that they submitted it to a lawyer, the lawyer looked at the report and just filed on all the names involved. Can't get money from someone you didn't name in the suit. Lawyer is probably fat too so it works out.

Can you counter sue? This is such a common tactic where I live anytime you are in an accident you tell the cop you think you may have a possible injury. It goes into the report and then if they sue you can file a counter suit for injuries and such. It's such a sad world we live in.

I wouldn't worry about it too much. They are going after your insurance company's money and denial of their bullshit claims. Not after you.

I woudl recommend that you do what I have done- keep the insurance on the vehicle itself to minimum required levels (face it, even your own insurance company won't give you shit for you car) and boost the medical up a whole bunch just to cover shit like this. The minimum medical coverage levels can be exceeded pretty quickly with today's medical costs.
