Depends on your jurisdiction. In the United states, if they did this intentionally, it'd likely be fraud.

Agreed. Most western jurisdictions see this as fraud.
Attempted fraud if intentionally and no contract concluded.
So basically 10/10 if presuppositions are met if merchant and buyer do reside in the same western society.
Prosecution if buyer and vendor do not reside in same country may be a problem.
