There is no law against giving birth in the US if you aren't a citizen or even here legally. Happens every day. Matter of fact, any baby born within the boundaries of the US, even if their parents crossed the border just to give birth, is a US citizen. They are called anchor babies in many cases.

Sorry, but it happens every day. Women come to the US as tourists all the time and then give birth. They may deny entry if they think you are coming here just to have the baby or can't afford to pay for it but I doubt they would deny a Canadian. Considering one of the fathers is an American citizen they would be very damn likely to allow it.

This has nothing to do with the parents being gay. The same thing would have happened if they were straight. The problem is one of the parents was not a US citizen when he conceived a child with another non-US citizen and said baby was born outside the US. Ergo the child is not a US citizen. The child is effectively the step child of the US parent. It doesn't matter that one of the parents is married to a US citizen (straight or gay), marriage does not imply citizenship, the married partner still has to apply whether they are straight or gay. Switch this couple with a straight couple where one member is not a US citizen and that member has a baby with a non-US citizen in another country and you would have the exact same problem (the baby is not a US citizen). There are several ways this could be fixed. The easiest is probably just have the US partner adopt the child. This is exactly what a straight couple would need to do with a step child. Alternatively the non US partner could claim US citizenship via his marriage now then try and add his child retroactively (I think this process would take longer and be more complicated but should work, I think).

The non-US partner can't just claim US citizenship. That isn't how that works. You first have to obtain a visa for entrance, then for conditional permanent residence and then permanent residence.

They had their spawn sperm and egg from another, implanted into a Canuck wamen, and gave birth to spawn in Canada. So the highly educated simpletons think they can get US citizenship because they are gay and demand it. The kiddies are Canucks. They should stay there.

However, being married to a US citizen, as far as I understand it, does make the process of applying for a visa, conditional PR, and then PR much much easier. I think the only way you get denied at that point is if you have a criminal record or the marriage itself is deemed a fraud (I could be mistaken).

Ahhh. Well this totally changes my opinion. I was thinking we needed a wall and strict citizenship requirements to keep from being raped and murdered by foreign hordes. But after reading, I just asked myself...how would this affect gay, jewish bi-nationals with kids? If strict immigration laws inconvenience gay, jewish bi-nationals with kids in any way, I, we, have a moral duty to stand opposed.
