Yep same here, used to take wifes return as well because of my loans. However getting a better paying job as an independant contractor. So I can at least skip my garnishment. Also my tax person worked some mojo so we keep our returns now.

I got loans gor about $8k, because of interest I owe like $50k+... Yay

Same thing happened to me, there is a form that you can fill out to get the return if you've filed jointly.

The best way out is to get that thing paid off ASAP, get a second job if need be.

^ right here. I pay my loans like a good goy every month on time. Wife and I lose about half our income to this, but it's better than the alternative.

If your employer will allow it, you can quit and be rehired. This will force a new garnishment order to be filed and may give you a chance to get to court and fight the garnishment. . But they often sue from different states then you reside in, depends on the state laws.

Are you in default? If not send them a letter along with 12 post dated checks for the amount you are willing to pay and state in your letter. Could be $20 per Check, just indicate it is all you can pay and when you have the means yo you will pay more. Will your credit score take a hit? Yes, but if your goal is to avoid bankruptcy, this is one way to do it. Not for everybody, but if you're hard up and need a way out, this MIGHT work depending on the laws in your area.

Edit...Are you in the states and is the debt 100% student loans?

The debt is down to about 50% remaining. And yes in PA. Student loans originated in Va.

Have you already defaulted on the loan and this is the reason they are garnishing your wages? Have they gotten a court order to do so?

It kind of depends on WHO is garnishing and why? A private party? Push the I am so poor and take this one lump sum or nothing approach.

Corporate? Agreed. Leave USA for a bit. They will to refile and find you.
