Women generally do not come with a penis. There can be no intercourse. Women can do all they want together with out technically having "sex". Which, by the way in the Greek, is why Romans 1:26 is not about women with women. It is about a man having anal intercourse with a woman. There is no prohibition against women with women in scripture. Also for men scripture only forbids anal intercourse. There are no other prohibitions. So, the picture looks like they were having fun.

I spent a good part of fifteen to twenty minutes looking at this picture, and can say without a doubt that there is no rape occurring in this photograph.

Rape requires sexual intercourse. That requires penetration of a pee-pee into a vajay-jay. Because (I assume) neither of these individuals have a pee-pee, no sexual intercourse can occur.

What you might argue here is that there is a sexual assault occurring. A sexual assault occurs when one touches the sexy private parts of another person without their consent. The California Penal Code defines sexy private parts as the victim's "sexual organ, anus, groin, or buttocks of any person, and the breast of a female."

However, I see two women. The woman on the bottom's right arm is lying on a keg, and her left arm is around the shoulder of the woman on top. And the woman on top has her right arm supporting her body by holding onto a keg, and I assume her other arm is doing the same. But the salient point here is that you can clearly see her left arm/hand is nowhere near the bottom girl's naughty bits. You might argue the lady on top's left hand is on the bottom ladie's breast, but given her angle it seems unlikely she would be able to maintain a prone position while still leaving that hand free. But regardless, you cannot see that her hand is touching the breast so at best it is speculation. So there isn't even a sexual assault occurring in the picture at the moment it was taken.

Now, just because these two women are making out on top of two kegs and are in various stages of undress, there is absolutely no evidence here that either are intoxicated In fact, there is no evidence at all of any drinking, as there are no cups around,no kegs appear to be tapped dispensing beer, and at least one of the kegs is still capped. This may be two models being paid to make-out for the purpose of being photographed. So it needs to be stressed that there is absolutely no indication that either of them are intoxicated to the point of being unable to consent. Especially absent any other evidence (like a video showing one girl saying no as her vajayjay is penetrated by the finger of the other, that would be nice if anyone can send me a copy).

But to answer the question that is on everyone's mind, if one or both of the girls were drunk, and one of them proceeded to sexually assault the other, that is one touched the anus, genitals, buttocks, or breast of the other without the other's consent, they could be tried for sexual assault. Of course proving this after the fact may become a she-said/she-said scenario that would significantly difficult get a conviction out of when there is the 'beyond a reasonable doubt' standard.

In conclusion, no it does not make a good point. The author is just ignorant.

I am happy you took the time to read this if you got this far. I am going to now go back to doing some more analysis of that photograph. For legal research.

I remember asking the same question years ago in Basic Training when they went over through the 'how to avoid raping someone' class. Basically what the instructor told us was that if, as a man, you are intoxicated don't have sex, as the woman can accuse you of rape and it will be seen as such by the military regardless of her level of intoxication. The target audience was a bunch of testosterone laden teenage guys so he probably was exaggerating...slightly.
