From what I understand, it is pretty much impossible to sue people in Germany. One of the reasons why it's so easy to in the states is because you have to cover your healthcare costs. In Germany it is covered by the insurance everyone pays.

Sueing to get damages over emotional distress in Germany, or the Benelux is actually very easy. Getting it is the hard part. You have to keep in mind however, that damages in Europe, and especially Northern-Europe, are very very low. For something like this, potentially fatal, do not expect to get much over €250 if that.
Some examples: my cousin got a ceasarian without proper anesthesia, they cut her open while she felt every bit. She got a really massive €750 out of it. My upstairs neighbour got his head smashed by a drunk driver, professor in economics, he will never work again, the insurance made a really big deal out of having to pay a court-ordered €5000 (potential wages and emotional distress), 6 years on they paid half. Haggling to get it down, because a 50 million turnover company cannot pay it. Tax service did demand and get their cash already.
