Flawed? In some ways. Its missing a lot of enforcement clauses really. For example, what is the penalty for the government violating someone's freedom of speech? How about for the executive branch for not enforcing a law? Interpretation by the judicial branch should not have gotten so far that a corporation is considered a person with free speech, where speech can be considered paying money for a political advertisement.

I think it's an excellent document, pretty well addressing what the limits of government should be even today.
I would say that it is becoming functionallly irrelevant, since the federal government frequently ignores it, and the populace basically accepts that.
