Do you respect a companies right to form contracts with it's own employees? Because that's the root cause of all of this. A private individual made a choice to knowingly violate a 100% legal agreement he signed with his voluntary employer, and was punished for it - nobody forced him to be an NFL player, and nobody forced him to sign a contract in which he agreed to abide by league rules and policies.
Unless you think that government should somehow be in charge of, or take priority over the legal, private dealings of individuals and business owners... because that seems awfully UN-conservative to me

You are failing to grasp that it doesn't matter if it's "performance enhancing" - the NFL's policy, which you can freely look up online, tests for the following:
“NFL Drug Panel”: Benzoylecognine (cocaine) ≥ 150 ng/mL Delta 9-THC-carboxylic acid (marijuana) ≥ 35 ng/mL Amphetamine and its analogues ≥ 300 ng/mL Opiates (total morphine and codeine) ≥ 300 ng/mL Opioids (e.g., hydrocodone, oxycodone) ≥ 300 ng/mL Phencyclidine (PCP) ≥ 25 ng/mL Methylenedioxymethamphetamine (“MDMA”) and its analogues ≥ 200 ng/mL Alcohol ≥ .06 g/dl (%)
Any player testing positive for, or admitting use of those substances is subject to disciplinary action that's clearly spelled out in the policy document. You need to understand that the NFL is a multi-state, national organization, it does not modify it's player behavior policies on a state by state basis.
Do you understand the basic concept of a contract? Do you comprehend that the NFL could contractually ban players from doing any number of perfectly legal things as a condition of their VOLUNTARY employment? If the NFL players contract said "you will never, ever wear blue socks - or you will be fired from the league" then that is legally binding, regardless of the legality of wearing blue socks wherever the player happens to live.
