There's no evidence that Nintendo was involved at all and very good evidence that they weren't: the emulator is still available for PC and Mobile on the Windows store, just not XBox. This is far more likely that Microsoft saw a $10 app that enabled the playing of hundreds of games as a threat to XBox games and cut it off now, also setting the precedent that emulators aren't okay on the XBox W10 store, which is fair because games are supposed to go through the XBox side of things.
As for the developer themselves, I've never been a fan of people repackaging open-source software and selling it like this, especially in direct competition to the free and OS version already available on PC. They can go screw themselves.

Well duh, it's Nintendo we're talking about here. They don't see people, they see walking wallets.
Why do people keep thinking Nintendo will just allow stuff like this?

Whether you like it or not, emulators themselves are 100% legal.

To be entirely fair: That emulator was not a fan project, the devs behind it (and with them, Microsoft) made money with the emulator, although I'm not sure how the customers did get the actual Game ROMs.
That being said, I think this takedown is justifiable. If it was a non-profit project, on the other hand, I'd tell Nintendo to sod off.

Oh man, I cant believe I missed it. I so desperately want to play EP1 Racer again, and it simply doesn't play on my computer.
